I’m delighted to see all the heat being brought to bear on Murdoch’s sleazy News Corp, so much so that it appears we’re going to need mothership diaries to track the action.
While this is good, the crimes of Big Government’s field operative, James O’Keefe, are quite similar in nature, much simpler to prosecute, and I believe a Department of Justice inquiry will reveal that it isn’t just luck that keeps Andrew Breitbart in the middle of all these events.

@JamesOKeefeIII was caught tampering with Senator Mary Landrieu’s phone system in 2010.
James O'Keefe, the young conservative filmmaker who was behind the undercover operations that led to the ACORN scandal last year, was arrested with three others for allegedly trying to tamper with the phones at the New Orleans office of Sen. Mary Landrieu (D-LA) yesterday.
This was a very straightforward crime. Why wasn’t it a felony? Could the answer be that one of the other three arrested, Robert Flanagan, is the son of western Louisiana U.S. Attorney William Flanagan?
The methods O’Keefe used to bring down ACORN included deceptive editing of videos, which is an unethical behavior that gets real journalists fired immediately. Some of the recordings used were made in Maryland, which has strict two party recording laws. This is a straightforward felony and the only reason the city of Baltimore hasn’t done anything about it is purely budgetary – they focus on thwarting violent crime.
There is a grassroots effort to Indict Breitbart – by either bringing pressure on the Baltimore city attorney, or Maryland Attorney General Doug Gansler.
IndictBreitbart.org is a new campaign to seek accountability for the violations of criminal law committed by Andrew Breitbart, James O'Keefe and Hannah Giles. O’Keefe and Giles illegally and surreptitiously recorded employees of the Baltimore ACORN office in the summer of 2009 and then their employer Breitbart illegally published their edited versions online in order to harm ACORN. This is a grassroots campaign to let law enforcement officials in Maryland know that ordinary citizens want accountability.
I’ve been on this issue for a while now, I recently posted Andrew Breitbart’s Hacking & Wiretaps, which provides numbers for the Maryland and California Attorneys General offices.
The crimes in Maryland are clear cut, and I include the California number because I think Attorney General Kamala Harris should look into the behavior of Breitbart toady John Patrick Frey aka Patterico. This @Patterico character I covered more fully in Patterico’s Penalization. This guy is a Deputy District Attorney, he spent six months frantically defending O’Keefe after the ACORN smear, and he’s been deeply and curiously involved in the post-Weinergate coverup. The investigator in me wishes to ask “So, Mr. Frey, what’s your interest in all this?”
These are strange, exiting days. Who would have thought two weeks ago that the exit of Glenn Beck would be just the start of the implosion of Fox News?
The loss of non-partisan, but low income voter focused ACORN was as if someone lopped an arm of the Democratic party. The crimes of those behind this scam are clear. We can’t let the excitement over the real possibility that Fox News might be dismantled serve as cover for this smaller, but equally dangerous conspiracy against the American people.
Call those Attorneys General in Maryland and California. Ask them to look at Breitbart. The Indict Breitbart site has other action suggestions. One really important action is this: donate. Campaigns like this are amazingly cost effective for us, but standing around clapping only goes so far - skip eating out one day this month and send them the price of that meal?
